FAIRNESS HEARING FAQs


B-1. What happened at the hearing?

The Court heard arguments from Class Counsel and the Defendant on whether the Defendant must pay interest to eligible Class Members, but did not make a decision.  Instead, the Court has taken the matter under advisement. 

No objectors attended the hearing.

B-2. What will happen after the hearing?

After the hearing, the Court will determine the amount of the restitution or damages and may determine any interest that may be owed to the Class Members and consider Class Counsel’s request for payment of attorney’s fees, litigation expenses and enhancement awards for the Class Representatives.  The Court will also consider any objections made to the payment of these fees, expenses, or awards.  

 

After the hearing, the Court will decide whether to make awards for these attorney fees, litigation expenses and enhancement awards applied for and how much to approve for each.  It is not known how long these decisions will take.

B-3. When is the hearing?

The hearing was held on August 1, 2018 at 10:00 a.m. EST at the Court of Common Pleas, Courtroom 22-D Justice Center, 1200 Ontario Street, Cleveland, Ohio 44113.

B-4. Do I have to attend the hearing?

No, Class Counsel appeared on the Class’ behalf.  The hearing was held on August 1, 2018.
